The standard reference process asks a candidate to nominate two people, emails them a form, and treats whatever returns as verification. Every element of that is weak. The referees are chosen by the person being assessed, the contact details are supplied by the person being assessed, and the questions invite opinion rather than fact. It is the least reliable control in most hiring processes and the one organisations trust most.
The answer is not to abandon references. It is to stop asking them to do a job they cannot do, and to move verification to the things that can actually be corroborated.
Why References Fail
Selection Bias Is Total
Candidates nominate referees who will speak well of them. That is rational behaviour, not misconduct, and it means a positive reference carries almost no information. The base rate of favourable references approaches one.
Employers Have Retreated to Facts
Many UK employers now provide only dates and job title as a matter of policy, driven by the risk of a negligent misstatement claim. A reference that confirms employment dates is useful for reconciliation and says nothing about performance.
The Channel Is Trivially Compromised
A referee email address supplied in an application can point anywhere. A phone number can be answered by anyone. Where synthetic applicants are involved, the referee is part of the fabrication, and a form sent to a supplied address verifies the fabrication against itself.
The Questions Invite Unfalsifiable Answers
Asking whether somebody is a good team player produces an answer that cannot be wrong. It feels like verification and functions as decoration.
What References Are Genuinely Good For
Two things, both narrow and both worth doing.
Factual reconciliation. Confirming dates, job title and reporting line against what the CV claims. This catches timeline fabrication, which is one of the more common forms.
Specific, checkable enquiry. Asking whether a named individual held a named role between named dates, and whether they had responsibility for a specific stated thing. Narrow factual questions get answered even by employers with restrictive policies.
Both require the channel to be independent. Establish the organisation's contact details yourself rather than using what the candidate supplied, and confirm the referee exists in the role claimed before weighing anything they say.
What Replaces the Rest
Register Checks
For any statutorily registered profession, the register is definitive, immediate and free. It shows current standing, not merely that an award once existed. One register check is worth more than three references, because it cannot be socially engineered.
Evidence Assessment at Sift
The question a reference is supposed to answer, can this person do the work, is better answered by examining whether the application evidences capability or merely claims it. For each essential requirement, record whether it is evidenced with corroborable specifics, claimed without evidence, or absent. That produces a comparable assessment across every candidate, which references never do.
Structured Depth at Interview
Take one claimed achievement three questions deeper: what the alternative was, who disagreed, what it cost, what you would change. Someone who did the work can continue because the detail exists to recall. This extracts more reliable information about capability than any reference form.
Work Sample Where Proportionate
A short, role-relevant task assessed against a published rubric tells you about capability directly. Keep it short, pay for anything substantial, and apply identical conditions to every candidate.
Identity and Eligibility Checks
Separate controls, and neither is a reference substitute. Identity verification addresses impersonation. A prescribed right to work check gives a statutory excuse. From 1 October 2026 the right to work scheme extends to workers on a worker's contract and individual sub-contractors, so it applies to considerably more engagements.
A Process That Works
- Sift on evidence rather than assertion, recording what is evidenced and what is only claimed.
- Interview for depth on the unevidenced claims, which the sift has already identified for you.
- Check the register where the role depends on registration.
- Verify qualifications at source, asking for the registration number rather than a certificate.
- Use references for factual reconciliation only, through independently established contact details.
- Complete the prescribed right to work check before work begins.
- Re-verify identity at onboarding for remote hires where weeks have passed.
Notice where references sit: step five, narrow, factual, and no longer carrying weight they cannot bear.
Legal Points Worth Knowing
There is generally no obligation on a UK employer to provide a reference, though some regulated sectors impose specific requirements. Where one is given it must be substantially true and fair, which is why restrictive policies exist.
References are personal data. A candidate can make a subject access request, and the position on disclosing a reference involves balancing the referee's interests. Assume anything written may be read by the subject.
Inconsistent reference practice creates discrimination risk. Requiring more referees, or deeper enquiry, for some candidates than others is the same problem as selective verification anywhere else. Apply one standard and record it.
Frequently Asked Questions
Should We Stop Taking References Entirely?
No. Use them for factual reconciliation, which they do adequately. Stop relying on them for capability assessment, which they do badly.
Is Contacting a Referee the Candidate Did Not Nominate Acceptable?
Approaching a current employer without consent can cause real detriment and should not be done without permission. Verifying that a nominated referee genuinely holds the role claimed, through the organisation's published contact details, is a different and reasonable step.
What About Safer Recruitment Requirements?
Some sectors mandate references from named individuals at the employing organisation, and those requirements stand. Follow them, and treat the wider verification stack as additional rather than alternative.
Do Character References Have Any Value?
Very little for capability. They confirm the person exists and knows somebody, which is rarely the question.
How Do We Handle a Refusal to Give a Reference?
It is common and frequently policy-driven rather than meaningful. Reconcile the dates another way and do not treat a restrictive policy as an adverse signal.
The Reframe
References ask a person selected by the candidate, contacted through details supplied by the candidate, to offer an opinion that cannot be checked. As fraud control that is close to useless, and as capability assessment it is worse than a structured sift.
Keep them for dates and titles. Move the real verification to registers, to source-checked qualifications, and to whether the application evidences the work rather than describing it. That stack is harder to fake and tells you more about honest candidates too.
